Jury Duty

I should mention at this point that I was later called (tap) to jury duty in a federal case of a dentist accused of inappropriate drug prescribing. I was predisposed emotionally to acquit, of course, and I eventually voted that way. Turned out that the other jurors followed my lead, and the dentist in question was acquited. One juror called my judgement, 'A travesty.' I didn't realize it at the time, but my reasoning during juror discussions apparently prevailed: we decided that the government had failed to prove, 'intent.' Our decision was 'logical' (as opposed to 'emotional.') even though I - Having done Ganja and LSD - was emotionally disposed to acquit. So my later advisement that I was 'unfit for jury duty' was based on firm evidence. I was telling the truth. They believed me, until recently, when I got a new 'jury notice.'
Was 'Mr. Gentile' a link in the chain of Arapahoe County's 're-evaluation' of my qualifications?
Who knows? I suspect. Maybe we shall see...
On the way back from Colorado Springs after a chess tournament I was alone with Gerash in Gerash's car. He was driving us both back to Denver. The conversation drifted to Jury duty. I boasted that I had been instrumental in the acquital of a dentist (tap) accused of 'drug pedalling.' Gerash replied that he was aware of that trial. 'You acquited,' he said.
Why would he know that?!
Gerash thereby became a prominent figure (tap) in my consciousness. He dropped me off at I-25 and Arapahoe Road. Kootch picked me up later. Interestingly, Gerash had picked me up before the tournament at I-25 and Arapahoe road! Hmm.
I would later conjecture that Gerash was all-too-familiar with our home at 7152 S. Franklin Street, and was anxious to avoid informing me that he knew where I lived.

Beginning beer #8 @ 1806L. No booze backup. Gonna have to ration the remaining 4 beers. Buzzing nicely at the moment...
Began a new game of C-III this week, #25 (?).
Dodged a bullet this week too: I was scheduled to appear for 'Jury Duty' monday morning. Yuk. So Sunday night I did research on the web concerning my obligation of citizenship. This led to a phone number. I reluctantly made the call. Wowza! My juror number was so high that I was among those few citizens excused! Alright! Whew. The last time I did jury duty was many years ago. I was in a room filled with hundreds of people. We were all given questionaires. There was a 'comments' section. I wrote that I was not a good juror prospect because I had no faith in the ACSD Criminal Justice System. Some time later a handful or two of people were directed to report to a room. My name was among that group. I was told that I had been excused and was free to go. Alright! (Just finished current beer. Gonna wait a while...)
My 'excuse' was based on actual experience with the ACSD and the CJS: Back in the early '70s I was 'arrested' in my back yard (faint boom) by an ACSD cop who was off duty acting as a security guard. I was shooting daisies at the time for lack of a better target. We had recently moved into our new home at 7152 S Franklin Street. The cop walked into our (unfenced at the time) back yard. Irritating. The cop then accused me of shooting out some windows in the new condo structures being constructed near our house. Not true! I denied the charge. The cop then took me to a nearby building under construction and showed me window damage suggesting a BB gun was involved. I denied doing the damage. The filthy ACSD cop then stated that he had witnessed me shooting (2 bonks above) in the direction of the damage. He then confiscated my BB gun and charged me with 'Malicious Mischief.' Unbelievable. (tap)

From Beer to Ecstacy and One Strange Trip.

First sip of beer #1 at 1533. Sip. Whew. It's been a long, strange, trip. Sip. No wonder the Founding Fathers decided to do this only once every four years. The House does this every two years, I think, and The Senate every six years. Lessee... and they all coincide every 12 years unless the H & S elections are intermingled every two years. (Hmm. That shows you how little I know about politics and the mechanics thereof. Civics bored the hell out of me in HS.) For the record I'm a lifelong 'Liberal Democrat/Independent' if there is such a thing. I even voted a few times, but that got me in trouble way back in late '50s-early '60s when, after voting in Kansas while in the military I was subjected to State Taxes. Major turnoff. After entering civilian life and moving to Colorado (tap) I tried the voting thing again in the '70s and was 'rewarded' by being put on the 'Jury Duty list.' But by then I was being stalked, and the ACSD was worse than useless. So I voted 'not guilty' in a federal case and the defendant was acquited when the rest of the jury went along with my (tap) reasoning. I was also 'smoking up' by then, and it was a 'drug case.' I was quite surprised when, some years later, Gerash told me that he was aware of how I had voted in that particular case! Huh?! That trial happened before I even knew Gerash! But Gerash knew me. Indeed, his 'mole' married my oldest daughter and even introduced us all to marijuana and LSD. A later attempt to introduce us to Cocaine failed, along with attempts (by others) to introduce me (alone) to Ecstacy and Heroin. I would have done Ecstacy (MDMA I think), but wouldn't touch Heroin with a ten foot pole. Gerash really fucked up when he put a 'drug afficionado' in our family and supplied us with Marijuana and LSD. We eventually grew our own Marijuana, but I haven't done LSD since about 1980. It is quite ironic that 'my stalker' provided me with the most stunning, mind-blowing experiences of my life!

A Carefully Calculated Diagnosis.

Working on beer #2 after watching the evening news. Sip. Would you like to know exactly how I came to be labeled with the Eternal Diagnosis? Of course you would.
It began with stomping on our ceiling. The upstairs neighbor was apparently stomping on his floor (our ceiling) in order to harrass me. The stomping eventually worked. I got very pissed off. Almost all previous neighbors had harrassed me is similar ways, and I knew it was being done 'on purpose.' After thinking about it for a few days I conjectured that Gerash was trying to harrass me into shooting my .38 into the ceiling, a very serious offense. I was not about to do that. The .38 was only for self defense in the event of home invasion or burglary - or - for suicide in the event of painful terminal illness. I'd had enough experience with the law to know not to shoot into the ceiling no matter how pissed off I became.
I decided to inform the offending neighbor that he was playing a dangerous game with somebody who had a gun. (Maybe that would stop his stomping.) I knocked on his door and complained about the stomping. Intending to inform him of the possible danger, I told him he was '38 bait.' Before I could explain further, he slammed the door and called the cops.
I tried to explain to the cops that Gerash, the stalker who employed him, was 'setting him up,' and that I was only warning him.
The cops arrested me.
The guy moved out soon after.
The cops turned me over to Kaiser where I was put on a 3 day Mental Health Hold, during which time I acquired the Eternal Diagnosis. I declined 'a trial of medications' and was released after 3 boring days.

Gerash was apparently quite pleased with the diagnosis; however there was one troublesome detail: The situation apparently required the diagnosing authority to formally warn Gerash that he might be in danger (from me). So the order (duty to warn) was cancelled by the diagnosing physician. Problem solved: Gerash was officially totally unaware that I thought he was stalking me. The only question is: How much money did Gerash have to pay for this carefully calculated diagnosis?
Oh, and by the way, when Gerash finally moved in upstairs some years ago, he had all the flooring replaced with hardwood. Since then he has lived above me, safe and secure, serving on the night shift. Only problem, my .38 Special has since become a .357 Magnum. Sip.
Oh, and one more thing: after that incident I adopted the policy of never trying to explain anything to the police, but to instead 'take the 5th.' It worked! Oh, and one more thing: I never again signed a 'plea bargain' with the D.A. I insisted on a 'trial by jury' instead. That worked too!

My First Encounter With Jewish Power

Very funny stuff here.
My very first encounter with the Arapahoe County Criminal Justice System occured in this very same back yard before there were fences in the area (tap). The occasion must have been about 1972 or 1973. One fateful afternoon I was in the back yard with my BB gun shooting wild flowers (for lack of better targets). There suddenly appeared a dude walking toward me. He entered my back yard as if he owned it! This definitely tended to piss me off. He identified himself as an off-duty police officer who was working as a part-time security guard for the condo complex just east of our house. He accused me of shooting out some windows (thunk) in the condos under construction. He then charged me with the crime of 'malicious mischief' and confiscated my BB gun. Whoa!
I was innocent of the charge. I was stunned and mystified. I was angry. I pleaded, 'not guilty.' I chose a 'trial to the judge' (not a trial to a jury - a huge mistake). I hired a lawyer. I expected to be fully vindicated. Wrong.
The trial date arrived. My lawyer and I appeared in court (lots of tap-tap above as I write this). As we were sitting in the hallway waiting for the trial to begin my lawyer advised me that the DA had offered us a deal: a 'deferred prosecution.' He did not explain the term to me in any detail - at least not in terms I understood. I rejected the offer: I was innocent and I intended to prove it in a court of law to an impartial judge.
A 'deferred prosecution,' I would later come to find out, was an offer to drop the charges after a certain length of time if the defendant committed no further crimes.
At trial my lawyer made absolutely no attempt to defend me! The cop lied under oath, describing how I had maliciously shot out condo windows. My lawyer failed to cross-examine him in any meaningful way. I could have put on a better defense myself! No evidence was presented (in the form of photographs, for example) other than the testimony of the cop. It was his word against mine. Surely the judge would rule 'not guilty' based on that lack of evidence.
Wrong: I was a solitary Irishman in the Jaws of Jewish Legal Power (boom).
